Purchase Terms and Conditions

All inquiries about or requests in accordance with these terms and conditions must be made in writing to Queensland Law Society (QLS) at events@qls.com.au.

These additional terms and conditions apply to all items purchased through the online QLS Shop. By purchasing items from the QLS Shop, you agree to these terms and conditions.

Definitions

Purchaser means the named person who electronically purchases items from the online QLS Shop.
Content includes on-demand videos, online self-paced courses and any other educational products purchased through the online QLS Shop.

1. Purchase of Content

1.1 QLS member discounts are available to QLS members where advertised. QLS membership fees for the current CPD year must have been paid in full before the member-discounted rate can apply.

1.2 Payment is required at the time of online ordering. All Content purchases are final on payment and cannot be cancelled or refunded as Content access is provided electronically to the Purchaser immediately and access cannot be reversed.

1.3 On payment, all Purchasers will receive a confirmation email sent to their specified email address which will contain a link to access the Content.

1.4 All purchases must be made in the name of an individual person only and their name and email supplied. Content cannot be purchased under an organisation name.

1.5 Only the named Purchaser of the Content has the right to access, view, download or print the Content purchased for their own personal, non-commercial use. The Content must not be shared or distributed to any other person.

1.6 Content must not be altered, sold or sub-licensed.

1.7 The information provided in QLS purchased Content is provided for professional development. QLS makes no representation or warranty regarding the accuracy, reliability, or completeness of the information or that the material is fit for any particular purpose. The information does not constitute legal advice given in the context of specific facts. Independent legal advice should be sought for specific factual circumstances. The information is provided on the basis that all persons accessing this information undertake responsibility for assessing the relevance and accuracy.

1.8 Only the named Purchaser can claim CPD points for viewing the purchased Content. A purchaser cannot share CPD points from one purchase. The allocation of CPD points is indicative only and it is the practitioner’s responsibility to ensure that CPD records are accurate in accordance with their attendance and/or viewing time. It is recommended that practitioners maintain their own separate record of CPD attainment. For further information on CPD points, refer to the CPD rules and policies.

Purchase of Advertising Products

The following advertising policy applies to advertising in all QLS’s publications, communications channels, platforms and EDMs.

2.1 All advertising material is subject to approval by QLS, who reserves the right to reject or amend advertisements it deems inaccurate, misleading, prejudicial, intolerant, irresponsible, unethical or inconsistent with its values.

2.2 The CEO or General Manager Membership and Engagement shall make the final decision on acceptance of any advertisement requiring such direction.

2.3 QLS reserves the right to change advertising or publishing format / frequency at its discretion.

2.4 An advertisement shall clearly identify the responsible manufacturer or provider of the product or service offered.

2.5 It is the responsibility of the advertiser to comply with all laws and regulations applicable to the marketing and sale of its product or service. In all instances, acceptance of an advertisement by QLS will not be interpreted as a guarantee that the manufacturer has complied with such laws and regulations.

2.6 Acceptance of advertisements by QLS does not indicate and should not imply endorsement by the Society.

2.7 No responsibility can be accepted for any loss arising from failure of all or part of an advertisement to appear or for any error in an advertisement.

3. Purchase of Brisbane Court Complex Access Card

3.1 Court ID cards can only be purchased by full or honorary members of QLS.

4. General

4.1 All purchase prices are published on the online QLS Shop in Australian Dollars and are inclusive of GST.

4.2 The QLS may collect personal data of those who purchase Content and such collection and use is subject to QLS’s privacy policy found here: https://www.qls.com.au/Content-Collections/Policies/Privacy-policy.

4.3 These terms and conditions (including the general website terms of use found here: https://www.qls.com.au/Content-Collections/FAQs/Website-terms-of-use) contain the entire understanding and agreement between the parties as to the subject matter of this agreement. All previous negotiations, understandings, representations or warranties concerning the subject matter of this agreement are merged and superseded by this agreement and are of no effect.

4.4 These terms and conditions are governed by and are to be construed in accordance with the laws applicable in the State of Queensland. Each party submits to the non-exclusive jurisdiction of the courts of the State of Queensland, and any courts which have jurisdiction to hear appeals from any of those courts, and waives any right to object to any proceedings brought in those courts.
